Police are reporting that a woman wanted for not rendering aid to an overdose victim has been captured.

On February 25, 2019, the South Kingstown Police Department (SKPD) and South Kingstown Emergency Medical Services (SKEMS) responded to a subject laying outdoors in a fetal position. SKPD Officers and SKEMS administered Narcan and the subject was transported by SKEMS to South County Hospital for treatment and injuries sustained as the result of an apparent opiate overdose.

Through investigation SKPD discovered that Julia Martin (age 28) had been using Fentanyl with the victim and failed to offer reasonable assistance, leaving the subject to suffer grave physical harm.

Martin was wanted in the incident, but has been located and arrested according to police.

While her failure to seek assistance for the overdose victim seems callous I question if it was criminal. If she herself was a long-term user of Fentanyl she most likely suffered from the long-term psychosocial effect of showing poor judgement in personal situations, coupled with being under the influence of the drug at the time she was non compos mentis and lacked the mental capacity to perform the required legal action of rendering aid or seeking assistance from someone who could. She cannot be punished for being sick. She needs treatment and not incarceration.
