Two Cape Cod men released on $40 bail after surrounding police officer, repeatedly firing BB gun

Two Massachusetts men have been arrested after being accused of surrounding and then firing at an officer late last night.

According to police, at approximately 11:00 p.m. 29-year-old Jordan Berrio of Centerville and 50-year-old Robert Carver of Hyannis, utilized their vehicles to surround and box in an unmarked Barnstable Police vehicle on Main Street in Hyannis. The two men then fired a BB gun at the driver’s side window and door, striking and causing damage to the vehicle.

The officer did not sustain any injuries.

Both Berrio and Carver fled the scene at a high rate of speed but were stopped moments later by responding units and taken into custody.

Berrio was charged with Assault by Means of a Dangerous Weapon, Discharging a BB Gun on a Public Way, Malicious Damage to a Motor Vehicle, Negligent Operation of a Motor Vehicle, and Speeding.

Carver was charged with Assault by Means of a Dangerous Weapon, Malicious Damage to a Motor Vehicle, Negligent Operation of a Motor Vehicle, Speeding, and Operating a Motor Vehicle without a License.

Both Berrio and Carver were released on $40 bail and are scheduled to be arraigned Monday at Barnstable District Court.

    $40 cash bail is the minimum bail amount in Mass. As a police officer in this “commonwealth” you are expected to be assaulted as “part of your job” Clerk-magistrates and Judges have repeatedly stated that on record. Usually as they dismiss such charges. Keep electing the D.A.’s who issue non-chargable offense lists and this will only get worse.

    Absolutely ridiculous. We don’t tolerate this nonsense here in Texas. One of the many reasons I moved away from Massachusetts. Quality of life here is 100x better, especially as a peace officer. Slap on the wrist, next time they may have actual firearms and seriously injure an officer or an innocent third party.
