Springfield man arrested in Fall River found not guilty on gun charges, guilty on resisting arrest

A Massachusetts man arrested in Fall River was found not guilty on most charges Wednesday in Fall River Superior Court.

According to Deputy Chief Barden Castro, on Wednesday August 7th, at approximately 7:45 p.m., Fall River Police Officers responded to the Maple Gardens Housing Development for a disturbance which was taking place inside of an apartment at that location.

In the home, officers spoke with 34-year-old Kyron Simmons of Springfield, Massachusetts. While interacting with Simmons, who was seated, a silver object was spotted behind him which was believed to be a weapon. Acting quickly, an officer took hold of the item which turned out to be a loaded revolver.

Once that firearm was seized, officers could now see a bag behind Simmons which was also removed from his possession. Inside that bag, two loaded semi-automatic pistols were found.

Simmons, who is ineligible to possess a firearms license, was placed under arrest.

Further inspection determined that one of the firearms had a defaced serial number and contained a high-capacity magazine.

Simmons was charged at the time with 3 counts of Carrying a Firearm without a License 3rd Offense, 3 counts of Carrying a Loaded Firearm in Public, Possession of a Large Capacity Firearm, Possession of a Firearm with a Defaced Serial Number, and Resisting Arrest.

On November 7th, Simmons was indicted in Fall River Superior Court.

On November 15th, he was arraigned in that same court on the 3 counts of Carrying a Firearm without a License 2nd Offense, Possession of a Large Capacity Firearm, and Resisting Arrest.

According to court records, Simmons was found not guilty on all charges except Resisting Arrest. He was sentenced to 2 1/2 years in jail with 218 days to serve and 2 years of probation. Simmons had already served the 218 days, so the sentence was deemed to be served.
