Fall River repeat offender sentenced after repeatedly assaulting girlfriend, stealing car

A 33-year-old Fall River man who twice assaulted his girlfriend and stole her car last Spring while on probation for a 2013 home invasion, was sentenced to serve eight to 10 year in state prison last Friday, Bristol County District Attorney Thomas M. Quinn III announced.

Harvey Maximin pleaded guilty in Fall River Superior Court to indictments charging him with assault and battery causing serious bodily injury, assault and battery on a family or household member, assault and battery with a dangerous weapon, assault on a family or household member and larceny of a motor vehicle.

This Defendant got into an argument with his girlfriend on two different dates, both of which resulted in the defendant violently assaulting her.

The first assault occurred on March 27, 2019. During that incident, the defendant punched her twice in the face and broke her jaw.

A week later, on April 6, the defendant got into another fight with her, during which time he took her keys from her causing a severe laceration to her finger, and then stole her car.

At the time of the two incidents involving his girlfriend, the defendant was on probation after serving a state prison sentence for a 2013 conviction on charges of home invasion, armed robbery and assault and battery with a dangerous weapon.

A separate violation of probation hearing was held in Fall River Superior Court last Friday. Judge Raffi Yessayan found the defendant to be in violation of the terms of his probation. In addition to the eight to ten year prison sentence for the assaults of his girlfriend, Judge Yessayan also ordered to defendant to be placed on supervised probation for an additional three years.

The case was prosecuted by Assistant District Attorney Kyle McPherson.

“While on probation for a home invasion, the defendant broke the victim’s jaw and later stole her car, and inflicted a another serious injury on her again. He is a menace who belongs off the street as long as possible to protect society,” District Attorney Quinn said.
