Two plead not guilty, third suspect facing manslaughter, in death of 45-year-old Fall River man

Two Fall River men were arraigned today in Fall River District Court concerning the death of 45-year-old Jose Roberto Zelaya. A third man was arrested this afternoon.

Jose Pagan, 23, of Fall River is charged with Accessory After the Fact to an Assault and Battery by Discharge of a Firearm. He pleaded not guilty.

Luis Colon-Delgado, 42, of Fall River, has been charged with Assault and Battery with a Dangerous Weapon. He also pleaded not guilty.

According to the Clerk’s Office, both Pagan and Colon-Delgado are being held without bail with a next court appearance on November 10th.

Anthony Miranda, 36, of New Bedford and Fall River, was arrested this afternoon and charged with Manslaughter, Assault and Battery by Discharge of a Firearm, Assault and Battery with a Dangerous Weapon, Carrying an Illegal Firearm and Carrying a Loaded Illegal Firearm. Miranda will be arraigned tomorrow in Fall River District Court.

According to Gregg Miliote of the Bristol County District Attorney’s Office, Massachusetts State Police detectives assigned to the district attorney’s office, Fall River Police and Homicide Unit prosecutors are actively investigating the homicide which occurred early Sunday morning in Fall River.

Shortly after midnight, Fall River Police were called to the Riverside Sports Bar and Restaurant on Rodman Street for a reported altercation and shooting outside the establishment. When first responders arrived on scene, they located a male victim on the ground.

Zelaya, was rushed to Saint Anne’s Hospital, where he was pronounced deceased at 2:20 a.m.

According to WPRI 12, a fight broke out inside the bar and then continued outside. Zelaya, who was outside and not involved in the altercation, tried to help the bouncer of the establishment when Pagan and his friends got upset with him.

The incident is still under investigation.
