Massachusetts man accused of having intimate relationship with 15-year-old while he was a police officer

BILLERICA – Middlesex District Attorney Marian Ryan has confirmed that Alexander Allen, 35,  has been indicted by a Middlesex Grand Jury on charges of aggravated rape of a child with a 10-year age difference and possession of child pornography. The charges are based on allegations that he had a sexual relationship with a 15-year-old female victim who was known to him.

In 2023, the defendant, who worked as a Billerica Police Officer, allegedly disclosed to an officer that he had an intimate relationship with a teenager.  The incident was reported to the Middlesex District Attorney’s Office by the Billerica Police Department and an investigation revealed that the defendant met the victim when she was 14-years old and grew close to her.  In March of 2021, two months before her 16th birthday, the defendant offered to pick her up at an appointment, drove her back to her home, where no one else was present, and engaged in sexual relations with the victim.  After that date and before the victim’s 18th birthday, he asked for and received a naked photo of the victim. 

Here is the timeline according to the Billerica Police Department.

On Dec. 6, 2023, the Billerica Police Department hired Discrimination and Harassment Solutions LLC, to conduct an independent investigation into the matter. Chief Frost notified the Massachusetts Peace Officers Standards and Training (POST) Commission, of the officer’s status and the investigation, recommending that Allen’s certification be temporarily suspended.

The POST Commission maintains a public record of all disciplinary actions against police officers in the interest of full transparency within law enforcement.

On Dec. 14, 2023, as the department’s investigation unfolded, Billerica Police contacted the Middlesex District Attorney’s Office, which opened a criminal investigation.

On Dec. 15, 2023, the Middlesex District Attorney’s Office requested that Billerica Police suspend its internal investigation to preserve the integrity of the DA’s criminal investigation.

On Dec. 18, 2023, Officer Allen resigned, and the department notified the POST Commission. Chief Frost has since requested that the POST Commission temporarily decertify Allen as a police officer. (In an update from the POST Commission, a chief may request for an officer to be suspended or decertified, but there is no such thing as “temporary” decertification. Decertification may happen after certain disciplinary proceedings take place. If an officer is decertified, they cannot ever again work for a law enforcement agency, a sheriff, or the Executive Office of Public Safety and Security in the Commonwealth in any capacity. Also, their names are placed in the National Decertification Index.) 

Allen was indicted on Oct. 3. Based on that indictment, another officer was placed on paid administrative leave on Tuesday, Oct. 8 pending the outcome of an internal affairs investigation into potential violations of departmental policy related to this case.

“The allegations against Allen, if proven, are deeply disturbing and represent a betrayal of the oath sworn by police officers to protect the innocent and serve the public with integrity,” Chief Frost said. “Upon learning of the allegations, we followed our established policies and procedures, which included launching an internal affairs investigation and notifying our district attorney. There is no room in the Billerica Police Department for the abhorrent behavior alleged in this case.”

Allen will be arraigned in Middlesex Superior Court in Woburn on October 25, 2024, at 10:00 a.m.
