Trial of Taunton man accused of killing another man in Fall River pushed back

The trial of a Taunton man accused of killing another man in Fall River in 2019 was pushed back Monday.

Joseph “JoJo” Noe is accused in the September 2019 shooting death of an Oak Bluffs man who was a member of the rival Sidewinders.

The trial was postponed by Judge Raffi Yessayan to August 22 of this year. The trial had previous start dates of 9/13/21, 9/20/21, and 1/18/22.

In September of 2020, Judge Renee Dupuis granted Noe $50,000 bail with a GPS bracelet and a stipulation that he is allowed only to leave home for work.

According to the Bristol County District Attorney’s Office, Noe was charged with one count of murder, one count of unlawful discharge of a firearm within 500 feet of a building and two counts of assault and battery by means of a firearm.

Police responded to JC’s Cafe on Bedford Street, for a report of a shooting with multiple victims. When police arrived, they located Eric Voshell, 39, suffering from an apparent gunshot wound. The victim was rushed to Charlton Memorial Hospital and was later transferred to Rhode Island Hospital, where he died.

Two other apparent gunshot victims, a 37-year-old Fall River man and a 23-year-old Bridgewater man, were also transported to area hospitals for treatment of non-life-threatening injuries.

Noe’s attorney, Rob Galibois, previously issued a statement upon his client’s release.

“I think the best comment that could possibly be made on the state of the evidence comes directly from the court herself. From her decision to release my client on bail, her honor wrote, ‘the facts of this case call into serious question the strength of the commonwealth’s case given the lack of evidence tending to support the commonwealth’s ability to prove that the defendant did not act in proper defense of another.’”

In response to the assertion that the shooting was premeditated, the MV Times stated that Galibois argued that Noe did not fire his gun until he saw his uncle getting beaten by armed members of the Sidewinders.

After watching video of the incident, the judge stated that Noe showed some restraint before he pulled out his gun and pointed it to the ground before firing.

A status hearing is scheduled for March 11.
