Plea deal tendered by Brayton Point LLC in lawsuit with Town of Somerset
An attorney representing the owners of the property that is the site of the former Brayton Point power plant was back in Fall River District Court this morning for the latest hearing in a lawsuit brought on by the town of Somerset.
Brayton Point LLC filed a tender of plea in the case, where the town of Somerset filed criminal charges against the company for failure to pay over $3 million dollars in fines stemming from operation of a scrap metal operation that violated town bylaws.
In March of this year, Brayton Point LLC made a motion to dismiss the charges, but Judge Pino then encouraged both parties to try and find a resolution.
The tend of plea entered on behalf of Brayton Point LLC is alleged to be for a fraction of the $3 million Somerset claims it is owed. Sources say the company wants to pay just $70k worth of fines.
At today’s hearing, the company also filed a motion to strike Somerset’s response to Brayton Point LLC’s motion for bill of particulars, which is the date and manner and means of the alleged zoning violations.
The case has been continued to June 18th.

In July of 2022, President Joe Biden visited the old Brayton Point power plant. The site was supposed to change from a coal plant to an offshore wind site. This was supposed to be a national emergency declaration to address the climate crisis.
It’s May of 2024 two years later where is the construction?

Actually there’s new towers and lines being constructed now to be ready for when the lines come ashore in addition to the ones already there. You can see the work from 195.

The town of Somerset needs to accept that BP LLC didn’t own the scrap metal operation. Just get on with the case and make a positive change moving forward. Let history be history and start over.

They need to pay what is owed,$3 million! They’ve done nothing but disrupt and pollute the Environment, and enable other Companies to do the same claiming its not them! Paid $8 mill. for the property.valued at over $100 mill. and inherited responsabilty to clean it up but have made it worse and not cleaned up the contamination! Hold them to the fire!
