Massachusetts Rep. files legislation targeting street takeovers after Fall River, Middleboro, Randolph, Brockton, Boston incidents; here’s what would happen

BOSTON – Representative Christopher Markey (Dartmouth) has filed HD5220 – An Act relative to protecting the public from street takeovers, in response to the rash of dangerous street takeover events across the Commonwealth that have resulted in several arrests, injuries, and damaged property in Fall River, Middleboro, Randolph, Brockton and Boston. Most notoriously, a Boston Police vehicle was burned while responding to a recent street takeover incident.

Markey’s Office states that the legislation will provide the Commonwealth and municipalities more tools to prevent, resist, and punish future street takeovers.

In summary HD5220:

  • Distinguishes street takeovers from traditional reckless operation of a vehicle
  • Allows for the forfeiture of vehicles utilized in street takeovers
  • Provides municipalities with the funds received from the sale forfeited vehicles
  • Elevates a disorderly person or disturber of the peace while masked to a jailable first offence

“I am deeply concerned by the danger last weekend’s street takeover incidents represent to public safety,” said State Representative Christopher Markey. “We have already seen multiple instances where property was damaged, law enforcement was assaulted, and bystanders were injured. This legislation takes an important step by giving law enforcement and municipalities the necessary tools to combat the crisis.”

Currently, HD5220 is before the House Clerk. From that point it will be referred to House Committee on Rules where it will receive its official committee placement.
