Man previously convicted of indecent assault sentenced in Fall River court on new indecent assault charge that took place at store
A 54-year-old Plainville man was convicted by a jury of his peers last week in Fall River Superior Court of indecently assaulting a woman in a North Attleboro furniture store in 2021, Bristol County District Attorney Thomas M. Quinn III announced.
David Puccio was convicted of indecent assault and battery on a person over the age of 14. He was sentenced by Judge Susan Sullivan to serve four-and-a-half to five years in state prison. This prison sentence will commence after Puccio completes serving a five-year sentence he began serving in December of 2022 for violating the terms of his probation connected to an indecent assault and battery of a child case out of Norfolk County.
On November 3, 2021, a female sales associate at Raymour & Flanigan in North Attleboro was approached by Puccio. He identified himself as “David” and stated he was looking for a bed for his mother. The victim spent about 45 minutes showing Puccio around the store. After showing the defendant around the store, he declined to buy anything, and the employee began to walk him towards the exit. Puccio then touched the victim’s right upper thigh and upper buttock area without her consent with an open palm. The victim, startled by the touching, jumped and asked him what he was doing? Puccio apologized, stating “I’m sorry. I’m Italian, I walk with my hands.” The victim told Puccio he needed to leave the store at which point the defendant replied- “the furniture in this store is gorgeous.”
The trial was prosecuted by Assistant District Attorney Catherine Sauter.
“I would like to thank the jury for holding the defendant accountable. The defendant is a convicted sex offender who was on probation and wearing an ankle bracelet when he committed this indecent assault. The defendant is a perverted individual, who is a danger to the community. The victim or anyone else should not have to put up with this depraved behavior. I am pleased that the court sentenced the defendant to the maximum sentence in addition to the sentence he is currently serving. It is well deserved,” District Attorney Quinn said.
