ERO Boston apprehends 28-year-old Guatemalan national charged with raping Massachusetts resident

BOSTON — Enforcement and Removal Operations Boston apprehended an unlawfully present, 28-year-old Guatemalan national charged with raping a Massachusetts resident. Officers from ERO Boston arrested Jorge Luis Castro-Alvarado Aug. 1 in Lynn.

“Jorge Luis Castro-Alvarado unlawfully entered the United States before making his way to Massachusetts and allegedly victimizing a resident here,” said ERO Boston Field Office Director Todd M. Lyons. “Castro posed a significant threat to the members of our community. ERO Boston will continue to prioritize public safety by apprehending and removing noncitizen threats to our New England neighborhoods.”

Castro unlawfully entered the United States on an unknown date, at an unknown location, without being inspected, admitted or paroled by a U.S. immigration official.

ERO Boston lodged an immigration detainer against Castro with the Essex County Sheriff’s Office Feb. 9, following his arrest for the offense of assault and battery on a family or household member.

The Lynn District Court convicted Castro of assault and battery on a family or household member. The court sentenced Castro to eighteen months in prison then suspended all but six months of the prison sentence.

The Essex County Superior Court arraigned Castro April 12 for two counts of rape and indecent assault and battery on a person over 14.

ERO Boston stated that the Essex County Superior Court released Castro from custody on bail without notification to ERO Boston despite an active immigration detainer in place. The court placed several conditions on Castro’s bail, including a GPS electronic monitoring requirement before releasing him back into the community.

Officers from ERO Boston arrested Castro Aug. 1 in Lynn and served him with a notice to appear before a Department of Justice immigration judge.
