ICE Boston announced the arrest of Marcel Jordan Lopes Da Silva, a three-time previously removed criminal illegal alien from Brazil, who had accumulated a series of local charges over more than two decades while living in the state. On October 21, 2026, the agency took him into custody; he remains detained pending removal proceedings.

According to ICE Boston, Da Silva’s record in Massachusetts courts dates back to the early 2000s and includes multiple motor vehicle, property, and assault-related cases. Many ended in dismissals or probation rather than incarceration.

The documented history includes:

  • July 14, 2003, Framingham District Court: arraigned for larceny and breaking and entering. He pleaded guilty and received a probationary sentence.
  • December 3, 2003, Holyoke District Court: arraigned for operating a motor vehicle after suspension. The case was later dismissed.
  • July 12, 2005, Brighton District Court: arraigned for motor vehicle homicide by negligent operation. He pleaded guilty and was sentenced to probation.
  • March 26, 2013, Framingham District Court: arraigned for assault and battery with a dangerous weapon. The case was later dismissed.
  • July 25, 2013, Boston District Court: arraigned for operating a vehicle after license suspension. The case was later dismissed.
  • July 8, 2026, Worcester District Court: arraigned for assault and battery on a person 60 years of age or older or disabled. The case was later dismissed.
  • October 20, 2026: arrested by the Marlborough Police Department for driving with a suspended license and operating a motor vehicle without lights. He was released on personal recognizance.

ICE Boston framed the case as an example of repeated encounters with the criminal justice system in a sanctuary jurisdiction that has limited cooperation with federal immigration detainers. The agency stated that it will continue prioritizing the removal of individuals with criminal histories to protect New England communities.

A photo of Da Silva circulated with the agency’s announcement shows a middle-aged man with dark, curly hair wearing a dark sweater.

This arrest is the latest in a series of publicized enforcement actions by ICE Boston targeting noncitizens with prior removals and local criminal charges in Massachusetts.
