Massachusetts Representative Alan Silvia files amicus brief with Superior Court supporting Auditor DiZoglio’s audit; here’s why

Boston, MA — State Representative Alan Silvia announced in a release that yesterday he filed an amicus brief with the Supreme Judicial Court, in support of State Auditor Diana DiZoglio’s audit of the Massachusetts Legislature and in opposition to Attorney General Andrea Campbell’s motion to dismiss, reinforcing his commitment to transparency and to constituents who have repeatedly called for the audit.

Rep. Silvia said his initial “no” vote on earlier procedural matters was cast after the Speaker of the House agreed to “work with the Auditor.” More than a year later, Rep. Silvia says that agreement has not been fulfilled and efforts to carry out the clear will of the voters are being stymied.

“It was my hope that the agreement to cooperate with the Auditor would produce meaningful progress. After more than a year and continued obstruction, I cannot stand by while the voters’ mandate is delayed,” Rep. Silvia said. “I have a responsibility and an obligation to advocate for my constituents, who daily demand that this audit be conducted in full.” I was sent to beacon hill to be an independent voice for my constituents. We talk about transparency and accountability, well let’s get it done. That is why I am supporting the Auditor and opposing the motion to dismiss.”

Silvia stated that the key reasons for filing the amicus brief include:

· To support the Auditor’s authority and the public’s right to an independent audit of legislative operations.

· To oppose efforts that would dismiss the audit and limit accountability.

· To honor the will of the people.

· To respond to constituent demands for transparency and oversight.

Rep. Silvia emphasized that this action is about defending voters’ rights to government accountability and transparency, affording the Auditor due process, and ensuring elected officials follow through on agreements to cooperate with independent oversight.
