52 new apartments in mixed use building among projects given go ahead by Fall River’s Zoning Board of Appeals

Several projects went in front of the Fall River Zoning Board of Appeals meeting in February.

MARINO Z. BENEVIDES, c/o Atty. David M. Assad requested a Special Permit under Section 86-423B of the City of Fall River Zoning Ordinance. The petitioner proposed to divide a lot into three lots, leaving an existing three-family dwelling (#94 Everett Street) on one lot, another existing three-family dwelling (#310 Alden Street) on a second lot, and the existing six-family dwelling (#84 Everett Street) on a third lot. The property is located within an “A-2” (Apartment) Zoning District.

The request was tabled to March’s meeting.

295 BEDFORD STREET LLC., c/o Atty. Peter A. Saulino sought to construct a mixed-use building on the property at 295 Bedford Street & 50 Seventh Street consisting of 52 residential apartment units and an approximately 8,000 sq.ft. adult day care facility. The petitioner sought variances for side yard setback and use in the Zoning District. The petitioner sought a Special Permit to waive the number of parking spaces required in the Zoning District as well as a Special Permit to waive the percentage of landscaping area required in the proposed
parking areas. The property is located within an “MD” (Medical) Zoning District and “HD” (Housing Development Overlay) Zoning District.

Level 1 will have the adult day care facility. Level 2 of the building will have 12 apartments (1 three bedroom, 4 two bedrooms, 7 one bedrooms) with 1 community room. Level 3 will have 13 apartments (1 three bedroom, 3 two bedrooms, 9 one bedrooms) and an exercise room. Level 4 will have 14 apartments (1 three bedroom, 2 two bedrooms, 11 one bedrooms). Level 5 will have 13 apartments (1 three bedroom, 4 two bedrooms, 8 one bedrooms).

As far as parking, there will be 74 on site with 52 for residential use, 10 for commercial use, and 12 for overflow.

The price tag for the market-rate housing project is currently at $20+ million, according to a letter submitted by Ken Fiola, Executive Vice President of Bristol County EDC.

The variances and special permits were granted by the Board.

TETRAULT REAL ESTATE LLC., c/o Atty. Peter A. Saulino is requesting a Variance to divide the existing parcel into two Lots, leaving the existing three-family dwelling at 72 Belmont Street (The Chauncey Sears House) on Lot #1 and creating a new conforming Lot #2. The proposal includes the provision of two off-street parking spaces per dwelling unit for the existing structure. Accordingly, the petitioner seeks variances for use, lot coverage and frontage as it relates to Lot #1. The property is located within an “S” (Single-family) Zoning District.

Most neighbors were against the variance and expressed concerns over what the new lot would become (single family structure) in addition to being upset that the barn on the property was torn down which also results in privacy concerns. The Art Association, which is a neighbor to the property, was in favor of the proposal.

The Board approved the variances.

AROUND THE CLOCK SERVICES INC., c/o Jeffrey Tallman requests a Special Permit under Section 86-423B of the City of Fall River Zoning Ordinance. The petitioner proposes to divide a lot into three lots, leaving an existing three-family dwelling (560 William Street) on one lot, another existing three-family dwelling (#570 William Street) on a second lot, and the existing single-family dwelling (#572 William Street) on a third lot. The property is located within an “A-2” (Apartment) Zoning District.

The request was tabled to March’s meeting.
